Pension campaigners claim the opinion given against them in the European Court of Justice, will not affect their plans to launch a judicial review.
The Advocate General of the ECJ said in her opinion there was not a “sufficiently serious” breach of community law, and the wording of Article 8 of the Insolvency Directive does not require the UK government “to make good shortfalls in pension benefits or that they must act as ultimate guarantor if pre-existing protective schemes are unable to offer adequate cover”.
