Pension sharing could apply to cohabiting couples

A proposal by the Law Commission on rights relating to co-habiting couples could see pension sharing orders becoming more commonplace.

The consultation paper, which closes on 30 September, puts forward the possibility of giving unmarried couple the same rights as those who are married or in civil partnerships. Published at the end of May, the consultation mainly focuses on the financial hardship suffered by people co-habiting, particularly if there are children involved, when a relationship breaks down. It suggests there should be rules in place to provide ‘financial remedies’ for cohabiting couples with children if they split up, which take into account contributions made to the relationship as well as sacrifices.
