A British couple have become the first successful claimants against the Spanish government to claw back CGT on their Spanish property, setting a precedent for others.
Thousands of British and European homeowners in the country were illegally charged more than twice the amount of CGT than Spanish residents on properties they sold in Spain. Having successfully reclaimed their overpayment after a year-long battle, the couple's case could now open the floodgates for thousands of other expats and home owners who have been affected to make similar claims to the Spanish government.
