The UK pre-Budget report announcement on the transferability of the nil-rate band has been well received. In light of these changes, is there still a need to create nil-rate band discretionary trusts? The new provisions are certainly good news for all couples who are UK domiciled. The problem currently is that, if an individual leaves his whole estate to his or her UK domiciled spouse, one of the nil-rate bands is effectively 'wasted' because there would just be an even higher liability on the second death. This would currently cost an estate £160,000 if the married couple or civil partne...
