The Court of Appeal recently ruled in the case of Airbus UK Ltd vs MG Webb that an employer may rely upon an expired warning when considering whether to dismiss an employee - but only in limited circumstances. In July 2004, Mr Webb was found washing his car during working hours. He was given a final written warning for gross misconduct involving misuse of his employer's premises and equipment, and misuse of company time.
