The increase to minimum statutory holiday entitlement has been in place since 1 October 2007. There appears to be a great deal of confusion among employers (and employees) about just what the new legislation means. Pre-1 October 2007 • All workers were entitled to four weeks' minimum paid holiday in each leave year. • There was no statutory right to take public holidays as paid leave. • Unused statutory holiday could not be replaced with payment in lieu, except where employment was terminated.
