An investigation by Nicholas Warren QC and Thomas Lowe into the House of Lords' decision on Equitable Life has found that it cannot be re-opened or challenged. However, Warren and Lowe found that this ruling does not preclude non-GAR policyholders from asserting contractual or other claims against the society, even if the economic effect of such claims succeeding would be to diminish the value of the guarantees to GAR policyholders.
